Many people overlook the importance, or the necessity, of having a power of attorney document in place as part of their estate planning. Wills are increasingly being mentioned as important to have in place, which is of course true, but it is equally, if not more important, to have a power of attorney document prepared in case incapacity strikes. In Alberta, there are very few options available, short of a professionally prepared Power of Attorney document to ensure that there is someone appointed to make financial decisions for you in case you cannot. Short of a Trusteeship Order from the Court of King's Bench, there are limited options and none, dependent on the type of financial decision that is needed. I will review the Alberta legislation, and highlight some scenarios that illustrate the effect of not including a power of attorney as part of your overall estate plan.

Craig is based in Calgary, Alberta, and brings over a decade of experience in trusts and estates, with extensive experience in fiduciary services and wealth management. He provides estate, trust, and incapacity planning services to clients in Alberta. Prior to joining Solus Trust, Craig held an estate and trust consultancy role with a bank-owned trust company in Alberta, where he also served as Senior Trust Officer, administering estates and trusts. Craig’s practical knowledge in trust and estate matters was further developed over his 11 years as a Supervisor with the Public Guardian and Trustee of Alberta.

Known for his thoughtful approach and deep understanding of trust structures, Craig delivers tailored solutions that align with clients’ long-term financial goals and estate planning needs. With a strong commitment to integrity and client service, Craig works closely with individuals, families, and professionals to navigate complex trust arrangements and ensure the seamless administration of estates. His expertise spans intergenerational wealth transfer, philanthropic planning, and corporate trust services.

Craig holds a Bachelor of Arts degree from Simon Fraser University in British Columbia and is a member of the Society of Trust and Estate Practitioners (STEP) Canada.
